# Terms of Service **Field Sales Companion** Version: 2026-03-01 · Effective: 1 March 2026 These Terms of Service ("Terms") govern your use of the Field Sales Companion mobile application and web dashboard ("Service"), operated by the service provider ("we", "us", "Operator"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. --- ## 1. Who may use the Service - You must be at least 18 years old (or the age of majority in your jurisdiction). - You must have been invited or authorised by your employer ("Company") to use the Service for work purposes. - You are responsible for keeping your login credentials secure. --- ## 2. What the Service does The Service helps field sales teams log customer visits, plan routes, manage follow-ups, and submit account requests. Features may change over time. --- ## 3. Your Company's role - Your Company assigns your account and may view data you enter in the course of your work (visits, routes, customers, notes, outcomes, and related information). - Your relationship with your Company (employment or contractor terms, confidentiality, discipline) is separate from these Terms. - We provide the platform; your Company is responsible for how it uses your data in accordance with employment law and its own policies. --- ## 4. Acceptable use You agree not to: - Use the Service for any unlawful purpose. - Upload false visit records, fake locations, or misleading information. - Copy, export, or misuse customer lists or confidential Company data for personal gain or competing businesses. - Attempt to access another user's account or Company data you are not authorised to see. - Reverse engineer, disrupt, or overload the Service. We may suspend or terminate access if you breach these Terms or if required by your Company. --- ## 5. Location, photos, and account requests - **Visit location:** When you log a visit, the Service may record GPS coordinates at that moment to verify the visit. This is not continuous background tracking unless a future feature explicitly states otherwise and you consent separately. - **Photos:** You may attach photos to visits. You must only upload images you have the right to use. - **ID documents:** Account request workflows may require identity documents. These are collected for verification only and are handled as described in the Privacy Policy. --- ## 6. Intellectual property - The Service, software, and branding remain our property or our licensors' property. - Data you enter on behalf of your Company in the course of authorised work may be owned or controlled by your Company under your employment or contractor agreement. --- ## 7. Disclaimer THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. We do not guarantee uninterrupted access, error-free operation, or that data will never be lost. You should not rely on the Service as your only record of business-critical information. --- ## 8. Limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law. --- ## 9. Indemnity You agree to indemnify and hold us harmless from claims arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party rights, except to the extent caused by our own negligence or wilful misconduct. --- ## 10. Changes to these Terms We may update these Terms from time to time. When we do, we will publish a new version and may require you to accept the updated Terms before continuing to use the Service. The version you accepted is stored with your profile. --- ## 11. Termination - Your Company or we may end your access at any time. - You may stop using the Service by requesting account deactivation through your Company or us. - Sections that by nature should survive (disclaimers, liability limits, governing law) will survive termination. --- ## 12. Governing law These Terms are governed by the laws of England and Wales. Courts in England and Wales shall have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you different rights. --- ## 13.
